Can I Sell Fish I Catch in California in 2024?

If you’re a commercial fisherman in California, you may be wondering if you can sell the fish you catch directly to consumers. The good news is that you can, but there are specific licenses and requirements you need to follow. In this article, we’ll explore the Fisherman’s Retail License and other relevant licenses, as well as the steps you need to take to legally sell your catch in California in 2024.
Fisherman’s Retail License
The Fisherman’s Retail License is required for fishermen selling all or a portion of their catch to the ultimate consumer. This license allows you to sell your own catch directly to the public, but it does not allow you to wholesale, process, receive, or sell others’ catch, or import product.
The annual fee for a Fisherman’s Retail License in 2024 is $130.81. It’s important to note that this license is not required if you have a Fish Receiver’s License.
Fish Receiver’s License
The Fish Receiver’s License is required for fishermen selling all or a portion of their catch to someone other than the ultimate consumer, such as a restaurant or retail market. This license can be used in place of the Fisherman’s Retail License.
In 2024, the annual fee for a Fish Receiver’s License is $1,019.00. If you plan to process the catch, you’ll also need a Fish Processor’s License, which has an annual fee of $1,019.00 in 2024.
Other Licenses and Permits
Depending on your specific situation, you may need additional licenses and permits from state and local authorities. For example:

Harbor/Marina Requirements

Local harbors and marinas may have their own requirements for selling your catch off the boat or at a dockside market.

City and County Requirements

City and county governments may require business licenses, vendor permits, and proof of permission from property owners if you plan to sell from a vehicle, stand, or private property.

Environmental Health Department Requirements

Some cities and counties have additional requirements for selling to individuals other than the ultimate consumer, such as Vernon and Los Angeles, Orange, and San Bernardino counties.
Steps to Sell Your Catch Directly to Consumers
To legally sell your catch directly to consumers in California in 2024, follow these steps:
Obtain the necessary licenses and permits, such as the Fisherman’s Retail License or Fish Receiver’s License, and any additional local requirements.
Keep detailed records of your sales to consumers, including the quantity and species of seafood acquired, the date, your full name and license number, and an indication that the seafood was sold directly to the consumer.
Submit monthly reports to the California Department of Fish and Wildlife, including all information required on the commercial receipt form and your trip tickets from that month.
Maintain proper handling and storage practices, such as keeping fish at a temperature of 41°F (5°C) or below at all times, using approved refrigeration equipment or ice made from potable water.
Ensure that all fish sales occur from your vessel between the hours of 7:00 am and 8:00 pm, and that no customers are allowed on the vessel.
By following these guidelines and obtaining the necessary licenses and permits, you can legally sell your catch directly to consumers in California in 2024. Remember to always prioritize food safety and comply with all state and local regulations.
