Is Hemp Cultivation Legal in Tennessee, and What Are the Regulations?

In Tennessee, the state government has differentiated between hemp and marijuana based on the concentration of THC, the psychoactive compound found in Cannabis sativa. Hemp, defined as Cannabis sativa with a THC content of less than 0.3%, is legal to cultivate within the state. Conversely, marijuana, which is Cannabis sativa with a THC content greater than 0.3%, remains illegal under state law.

The Tennessee Department of Agriculture oversees the regulations and guidelines for hemp production, offering resources for producers looking to navigate the hemp industry. For those interested in understanding the specifics of hemp cultivation, the department has detailed rules updated as of November 2021.

Despite the legalization of hemp, law enforcement in Tennessee faces challenges due to the inconsistencies in hemp and marijuana laws across different states and the resulting enforcement responsibilities. The Tennessee Drug Investigation Division manages enforcement with support from entities like the Drug Enforcement Administration (DEA).
