Is Recreational Cannabis Now Legal in Minnesota?

Minnesota has recently made significant strides in the legalization of recreational cannabis. This move marks a pivotal change in the state’s stance towards marijuana use. As of August 1, 2023, adults aged 21 and over are allowed to possess or publicly transport up to 2 ounces of cannabis flower and 8 grams of cannabis concentrates. Additionally, they can have up to 2 pounds of marijuana in their homes. For edible cannabis products, the possession limit is set at 800 milligrams of THC.

The journey towards legalization saw its early beginnings with the legalization of medical marijuana in Minnesota in 2014. The recent bill carries protections for the medical marijuana market, ensuring that licensed medical suppliers can produce and sell recreational cannabis, with the amount allowed based on the percentage of their business.

The bill, known as HF100, was passed in the House with a 71-59 vote after extensive debate. It represents a significant shift in policy and public opinion, reflecting the growing support for cannabis legalization nationwide. The House Ways and Means Committee also played a crucial role in this process, approving the bill on April 17, 2023. An important aspect of the bill includes provisions for educational initiatives, with $9 million allocated in fiscal year 2025 to the Department of Health for developing educational materials on cannabis.

Governor Tim Walz officially signed the bill into law on May 30, 2023, marking a historic moment for the state. This law not only legalizes adult-use cannabis but also addresses the expungement or resentencing of cannabis convictions, a significant step towards criminal justice reform.

Minnesota’s approach to cannabis legalization has been thorough, with the Legislature conducting over two dozen hearings on the subject. This comprehensive process has ensured that the state’s transition into legalizing recreational marijuana is well-informed and considerate of various impacts.
