What Does Missouri’s New Adult-Use Marijuana Law Entail?

Missouri’s recent amendment to its marijuana laws, known as “Amendment 3”, signifies a significant shift in cannabis regulation within the state. This amendment, effective from December 8, 2022, legalizes marijuana for adults aged twenty-one and over, while also implementing a comprehensive system for its commercial production, distribution, and regulation.

Under the new law, adult-use marijuana can be purchased by consumers who are at least twenty-one years of age. Each transaction allows the purchase of up to 3 ounces of marijuana, with consumers legally allowed to possess the same amount at any given time. Additionally, adult-use purchases are subject to a 6% tax, in addition to any applicable local taxes.

The regulation of marijuana in Missouri also extends to medical use. Medical marijuana refers to strains of cannabis with a THC content greater than 0.3% on a dry weight basis. Despite the legalization of medical marijuana in Missouri, it’s important to note that marijuana possession remains a federal offense, as federal law still applies.

The Division of Cannabis Regulation, located in Jefferson City, MO, is the primary point of contact for inquiries and information regarding marijuana regulation in Missouri. This division oversees the licensing and regulation of marijuana facilities and provides guidance on compliance with state laws and regulations.

The implementation of this law marks a milestone in Missouri’s journey with medical marijuana. Since the first sale to a qualified patient in a Missouri medical marijuana dispensary, the program has seen significant growth, reaching $200 million in total sales by December 20, 2021. This growth reflects the expansion of facilities operating in the state, including cultivators, manufacturers, dispensaries, testing laboratories, transporters, and seed to sale providers.
