Is Marijuana Legal in Idaho According to State Laws?

In Idaho, marijuana remains a Schedule I controlled substance under state law. This classification means it is illegal for any person to manufacture, deliver, possess with intent to manufacture or deliver, or possess marijuana. This includes all parts of the cannabis plant, as well as any cannabis preparation containing tetrahydrocannabinol (THC).

The Idaho Marijuana Use Fact Sheet updated in January 2022 reiterates the state’s policy on the substance. Despite marijuana legalization in several states for medical or recreational use, Idaho maintains its prohibition. However, the Idaho Medical Marijuana Act, Chapter 97, was cited, but it should be noted that marijuana legalization has not occurred in the state.

The legal status of cannabis in Idaho is further supported by specific statutes such as Section 37-2732B and Section 37-2705 of the Idaho State Legislature, which outline the prohibitions and penalties associated with marijuana trafficking and the classification of controlled substances, respectively.

Additionally, the Sergeant Kitzhaber Medical Cannabis Act, known as HOUSE BILL 108, was introduced to amend existing law to authorize the use, possession, distribution, and transportation of cannabis for medical purposes. It should be noted, however, that this bill’s status should be confirmed as to whether it was enacted or not.

Regarding cannabidiol (CBD), Idaho law specifies that CBD products must contain no THC to not be classified as marijuana under state law.

In terms of invasive species, Idaho has designated 71 weed species and 4 genera as noxious, indicating the state’s proactive stance in managing potentially harmful terrestrial plants. This does not directly relate to the legal status of marijuana but shows an aspect of plant management in the state.
