Kentucky has made significant strides in the realm of medical cannabis, marked by key legislative and regulatory developments. On March 31, 2023, a historic moment unfolded as Governor Andy Beshear signed Senate Bill 47 (SB 47) into law, effectively legalizing medical cannabis in the state. This legislation, which came into effect on January 1, 2025, permits the purchase of medical cannabis with a written certification. However, it’s important to note that consumption outside the medical cannabis program remains illegal in Kentucky.
An important aspect of this legislation is the provision regarding the purchase and possession of cannabis. Kentuckians must buy cannabis within the United States in states where its purchase is legal and regulated. Additionally, the law stipulates that individuals must keep their receipts and that the quantity of cannabis they can purchase and possess at any one time must not exceed 8 ounces. This limit distinguishes between a misdemeanor and a felony under Kentucky law.
Governor Beshear has been proactive in forming the Team Kentucky Medical Cannabis Advisory Committee, which was established in June 2022. The committee’s role was to travel across the state and gather Kentuckians’ views on medical cannabis. The feedback, summarized and released on September 30, 2022, indicated a strong consensus among Kentuckians for the legalization of medical cannabis.

The regulations cover various aspects, including the procedures for the issuance, renewal, suspension, and revocation of licenses related to medical cannabis.
In a move to gather diverse perspectives and expertise, Governor Beshear, on June 14, 2022, announced the initial members of the Team Kentucky Medical Cannabis Advisory Committee. This committee comprises individuals from various backgrounds, including advocates, legal experts, and medical professionals, such as Louisville Dr. John Farmer, an OB/GYN.
Furthermore, Governor Beshear has demonstrated commitment to incorporating public feedback into the program’s next steps. This approach ensures that the implementation and evolution of the medical cannabis program in Kentucky are aligned with the needs and opinions of its residents.
